Types of Public Infrastructure Definition set forth in the
Enforcement Rules of Act for Promotion of Private Participation in Infrastructure Projects
Scope of Major Infrastructure Projects
Transportation Facilities Article 2 I. Railways, highways, (metropolitan) expressways, public rapid transit systems, light-rail transportation systems and intelligent transportation systems where the overall investment (excluding cost of land) amounts to more than NT$1 billion.
II. Transfer hubs that meet any of the following requirements:
(1) The overall investment (excluding cost of land) shall amount to over NT$500 million.
(2) The land area applied for development shall be more than half (0.5) a hectare.
(3) The building site shall have more than 6,000 square meters and the total floor area of the building shall be more than 30,000 square meters.
III. Airports and affiliated facilities that meet any of the following requirements:
(1) The overall investment (excluding cost of land) shall amount to over NT$3 billion for the facilities and equipment for the embarkation/debarkation of passengers and cargo as well as facilities in the area where aircraft take off and land.
(2) The overall investment (excluding cost of land) shall amount to more than NT$1 billion for the maintenance garages/docks, fuel supply and storage facilities, waste water treatment facilities, incinerators, facilities for value-added activities of air transportation, facilities for aviation training, hotels for transit passengers, exhibition centers, international convention centers, and parking lots.
IV. Harbors and affiliated facilities where the overall investment (excluding cost of land) amounts to more than NT$1 billion.
V. Off-street public parking lots that meet any of the following requirements:
(1) Multi-storey parking facilities with a total floor area of over 8,000 square meters.
(2) Parking facilities with lifts or towers with an overall investment (excluding cost of land) amount of more than NT$30 million.
VI. Bridges and tunnels where the overall investment (excluding cost of land) amounts to more than NT$200 million.
Common Conduits Article 3 Common conduits with a length of more than 2 kilometers or an overall investment (excluding cost of land) of more than NT$500 million.
Environmental Pollution Prevention Facilities Article 4 Any of the following environmental pollution prevention facilities:
I. Facilities that are built with the participation of the private sector, designated by various levels of environmental protection authorities or by the competent central authorities of the relevant industries, for storage, removal, treatment or reuse of waste, where the overall investment (excluding cost of land) amounts to more than NT$100 million, as
II. Private incinerators that are established pursuant to the Guidelines for Promoting the Construction of Solid Waste Incinerators by Public and Private Institutions and where the overall investment (excluding cost of land) amounts to more than NT$400 million.
III. Sites and affiliated facilities that are established with participation of the private sector under the guidance of all levels of construction competent authorities for storage and disposal of the earthwork left over from construction where the overall investment (excluding cost of land) amounts to over NT$100 million or where the daily process volume of earthwork amounts to more than 1,000 cubic meters.
Sewerage Facilities Article 5 Sewage treatment plants and affiliated facilities where the daily process volume of sewage amounts to more than 10,000 tons.
Water Supply Facilities Article 6 Water purification plants and affiliated facilities where the daily process volume of water amounts to more than 10,000 tons.
Water Conservancy Facilities Article 7 Any one of the following water conservancy facilities:
I. Water diversion facilities where the daily volume of diversion amounts to more than 100,000 cubic meters
II. Water storage facilities where the storage capacity amounts to more than 300,000 cubic meters.
III.  Seawater desalination plants and affiliated facilities where the daily production volume amounts to more than 2,000 cubic meters, or 200 cubic meters for those on Taiwan's outlying islands.
IV. Water reclamation facilities (including reclamation water channel, catchment and reuse of rainwater, recycling and reuse of wastewater and sewage) where the daily volume of supply amounts to more than 2,000 cubic meters.
V. Groundwater replenishment facilities where the daily volume of replenishment amounts to more than 10,000 cubic meters.
VI. Flood or tide prevention facilities where the area of flood protection or mitigation amounts to more than 1 hectare within urban planning zones or more than five hectares within non-urban planning zones.
VII. Water turbine generators, water generation plants and relevant distribution equipment, transformers and other facilities related to the development of water power where the combined output amounts to more than 2,000 horsepower and where the overall investment (excluding cost of land) amounts to more than NT$210 million.
Sanitation And Medical Facilities Article 8 Sanitation and medical facilities that are established and approved in accordance with relevant laws and meet any of the following requirements:
I. The location shall be in areas with insufficient sanitation and medical resources, as specified by central sanitation competent authority.
II. The land area applied for development shall be more than 2 hectares.
III. The overall investment (excluding cost of land) shall amount to more than NT$500 million.
Medicament manufacturing factories of sanitation and medical facilities mentioned in the Paragraphs above are only applicable to vaccine production facilities.
Social Welfare Facilities Article 9 I. Funerary and crematory facilities established and approved in accordance with relevant laws where the overall investment (excluding cost of land) amounts to more than NT$100 million.
II. Any one of the following social housing:
(1) The land area for social housing is more than half (0.5) a hectare.
(2) The total floor area of the building calculated based on floor area ratio for social housing is more than 5,000 square meters.
III. Long-term care service institutions with institutional residential services that are established and approved in accordance with relevant laws and meet the following requirements:
(1) The overall investment (excluding cost of land) shall amount to over NT$350 million.
(2) Provide residential long-term care services and have more than 100 beds.
(3) The total floor area of the institution is over 2,700 square meters, and the allocated area per person shall not be less than 27 square meters.
(4) Provide more than 30% of the beds to economically or socially disadvantaged individuals.
Labor Welfare Facilities Article 10 Institutions and affiliated facilities for entertainment, training and education of the labor force established pursuant to Subparagraphs 4 and 5, Paragraph 1, Article 8 of the Act for Promotion of Private Participation in Infrastructure Projects (the "Act") where the overall investment (excluding cost of land) amounts to more than NT$50 million.
Cultural And Educational Facilities Article 11 Any of the following cultural and education facilities:
I. Public senior high (or vocational) schools, and schools of higher levels education, as well as the affiliated facilities, where the overall investment (excluding cost of land) amounts to more than NT$100 million.
II. Public junior high schools or public elementary schools and the affiliated facilities where the overall investment (excluding cost of land) amounts to more than NT$50 million.
III. Social education institutions, cultural institutions, education institutions as well as the affiliated facilities where the overall investment (excluding cost of land) amounts to more than NT$50 million.
IV. Reclamation, operation, management, and maintenance of Cultural Heritage where the overall investment (excluding cost of land) amounts to more than NT$50 million.
Tourist Attractions And Lodgings Article 12 Any of the following facilities for Tourist Attractions And Lodgings:
I. Facilities established in accordance with Subparagraphs 1, 2 and 4, Paragraph 1, Article 8 of the Act where the overall investment (excluding cost of land) amounts to more than NT$300 million.
II. Facilities located in the remote areas specified central competent authority and established pursuant to Subparagraph 6, Paragraph 1, Article 8 of the Act where the overall investment (excluding cost of land) amounts to more than NT$300 million.
III. Facilities established in accordance with Subparagraph 6, Paragraph 1, Article 8 of the Act where the overall investment (excluding cost of land) amounts to more than NT$1 billion.
Power Facilities Article 13 Power facilities where the overall investment (excluding cost of land) amounts to more than NT$2 billion.
Public Gas And Fuel Supply Facilities Article 14 Public gas and fuel supply facilities where the overall investment (excluding cost of land) amounts to more than NT$2 billion.
Sports Facilities Article 15 Any of the following sports facilities:
I. Single-purpose sports facilities with a seating capacity of more than 3,000 where the overall investment (excluding cost of land) amounts to more than NT$250 million.
II. Sports and recreation parks where the overall investment (excluding cost of land) amounts to more than NT$1 billion while the investment for sports facilities amounts to more than NT$300 million.
Parks And Green Spaces Article 16 Facilities under this Article are not included.
Industrial Facilities Article 17 Telecommunication parks that are established pursuant to Subparagraph 6, Paragraph 1, Article 8 of the Act and meet the following requirements:
I. The area of development shall be more than 7 hectares.
II. The overall investment (excluding cost of land) shall amount to more than NT$3 billion.
III. Telecommunication platform and affiliated facilities with research, development and testing abilities as determined central competent authority
Commercial Facilities Article 18 I. Large logistics centers that meet the following requirements:
(1) The land area applied for development shall be more than 2 hectares.
(2) The overall investment (excluding cost of land) shall amount to more than NT$600 million.
II. International exhibition centers that meet the following requirements:
(1) The exhibition center shall have a base area of more than 3.5 hectares and more than 1,200 standard exhibition booths installed.
(2) The exhibition center shall have more than 1,000 parking spaces for cars/sedans.
III. International convention centers that meet the following requirements:
(1) The convention center shall have a base area of more than 1.5 hectares, a grand conference hall with a seating capacity of more than 2,000 and more than two conference rooms each with a seating capacity of more than 800.
(2) The convention center shall have more than 400 parking spaces for cars/sedans.
Hi-Tech Facilities Article 19 Facilities under this Article are not included.
Development Of New Towns Article 20 Facilities under this Article are not included.
Agricultural Facilities Article 21 I. Agricultural products wholesale markets where the overall investment (excluding cost of land) amounts to more than NT$600 million while the land area applied for development shall be more than 2 hectares.
II. Agricultural facilities established pursuant to Paragraph 5, Article 21 of these Enforcement Rules of Act for Promotion of Private Participation in Infrastructure Projects (except for recreational agricultural facilities) and meet the following requirements:
(1) Facilities shall be established pursuant to Subparagraphs 1, 2 and 4, Paragraph 1, Article 8 of the Act and the overall investment (excluding cost of land) shall amount to more than NT$300 million.
(2) Facilities shall locate in the remote areas specified by the competent central authorities of the relevant industries and established pursuant to Subparagraph 6, Paragraph 1, Article 8 of the Act where the overall investment (excluding cost of land) amounts to more than NT$300 million.
(3) Facilities shall be established in accordance with Subparagraph 6, Paragraph 1, Article 8 of the Act where the overall investment (excluding cost of land) amounts to more than NT$1 billion.
III. Agricultural facilities established pursuant to Subparagraphs 1 and 2, Paragraph 6, Article 21 of these Enforcement Rules of Act for Promotion of Private Participation in Infrastructure Projects and any of the following requirements:
(1) Facilities for value-added activities of fishing where the overall investment (excluding cost of land) amounts to more than NT$200 million.
(2) Facilities for accommodation, food and beverage, exhibition and ocean-related recreation and education where the overall investment (excluding cost of land) amounts to more than NT$300 million.
Government Office Buildings Article 22 Government office buildings where the overall investment (excluding cost of land) amounts to more than NT$1 billion.
