Article 1

In order to conduct an examination to set up the recommended conditions for public tender or projects for national non-public use lands, in accordance with the Article 4 of the "Operation Directions for Establishment of Superficies on National Non-public Use Land", the National Property Administration, Ministry of Finance (hereinafter referred to as the NPA) hereby establishes these regulations. 

Article 2

The review team setting up superficies on national non-public lands (hereafter referred to as review team) shall have thirteen to fifteen Commissioners, and be composed of the following members, of which the proportion of Commissioners of either gender should reach one-third.

1. Deputy Director-General of the NPA, and the convener.

2. A representative of the National Land Management Agency, MOI.

3. A representative of the Taipei City Government.

4. A representative of the New Taipei City Government.

5. A representative of the Taoyuan City Government.

6. A representative of the Taichung City Government

7. A representative of the Tainan City Government.

8. A representative of the Kaohsiung City Government

9. Five to seven specialists and scholars.

The personnel listed in Subsection 2 to 9 of the preceding paragraph shall be appointed by the NPA. When there is any vacancy among the Commissioners, a replacement may be appointed.

The tenure of personnel listed in Subsection 1 to Subsection 8 of Paragraph 1 shall be the same as that of his/her primary official post. The tenure of the member listed in Subsection 9 of Paragraph 1 shall be one year, and may be renewed upon expiry.

Article 3

The following matters shall be considered by the review team.

1. Matters pertaining to the examination of the setting of the duration of the superficies, royalty base price, or royalty and rent of the project providing superficies setting

2. Other matters pertaining to the establishment of superficies on national non-public use land.

Article 4

The meeting of the review team shall be held once every three months in principle, and may be increased or decreased as necessary.

Article 5

A majority of the Commissioners who are required to attend meetings shall be present at the meeting.

Article 6

The review team shall consult with the Division of Business Affairs of the NPA as the staff unit, which is responsible for handling the regular affairs of the review team.

Article 7

When meeting, the review team may invite local government and relevant authorities (organizations) to attend the meeting to explain or present their opinions, depending on the needs of the case review operation.

Article 8

The conclusion of the examination made in the review team's meeting shall be carried out in the name of the NPA.

Article 9

The Commissioners of the review team all are positions of no pay, but the specialists and scholars attending the meetings may be issued meeting attendance fees in accordance with the regulations. However, external members may be paid part-time or attendance fees in accordance with the regulations.
