Content: 1. These Operation Directions are enacted for the purpose of rewarding private participation in infrastructure projects and enhancing the effectiveness of promoting private participation in infrastructure projects.

2. Award Categories
 (1) Government Team Award
     The award is granted to the authority-in-charge and/or authorized (or commissioned) agencies' working team that have made specific contributions to promoting private participation in infrastructure projects (hereinafter referred to as "PPP projects"); members may include consulting institutions commissioned by government agencies to assist in promoting PPP projects with good performance, and the number of such institutions shall be limited to two.
 (2) Private Team Award
     The award is granted to the private teams that demonstrate excellent service quality in operating and managing infrastructure projects. Members may include applicants for PPP projects and their members, private institutions and their members, or vendors. The term “members” or “vendors” as referred to herein means legal entities, with a limit of five entities.
 (3) Additional Award
     A. Innovation Award
        The award is granted to government teams selected for the award category provided in Subparagraph 1 and have demonstrated specific and outstanding achievements in project innovation.
     B. Public Welfare Award
        The award is granted to private teams selected for the award category provided in Subparagraph 2 and have demonstrated specific and outstanding achievements in fulfilling public welfare such as social responsibility.
     C. Bilingual Benchmark Award
        The award is granted to private teams selected for the award category provided in Subparagraph 2 and have demonstrated specific and outstanding achievements in promoting the national bilingual policies.

3. Award Methods
 (1) Government Team Award
     A. Government Agencies
      (A) Trophies will be presented; encouragement awards will be presented to team members. 
      (B) Each team receiving the High Distinction Award shall be awarded NT$500,000; each team receiving the Excellence Award shall be awarded NT$300,000; and each team receiving the Honorable Mention Award shall be awarded NT$100,000. The awarded agencies shall distribute the prize money among team members based on their level of contribution. 
      (C) Team members shall be granted awards in accordance with the Public Functionaries Merit Evaluation Act. Team members of the projects receiving the High Distinction Award may be awarded a maximum of one Major Merit; team members of the projects receiving the Excellent Award may be awarded a maximum of two Merits; and team members of the projects receiving the Honorable Mention Award may be awarded a maximum of one Merit.
     B. Consulting Institutions
      (A) Trophies will be presented.
      (B) The Ministry of Finance may publish the list of award winners on the website of Promotion of Private Participation (hereinafter referred to as the PPP Information Website) to recognize their outstanding achievements.
      (C) The provision regarding the reduction of bid bond and performance bond for outstanding suppliers, as set forth in Article 33-5 of the Regulations for Bid Bond, Guarantee Bond and Other Guarantees, shall apply to the institutions winning the High Distinction Award and the Excellence Award. The incentive period for the High Distinction Award is two years, and the incentive period for the Excellence Award is one year.
 (2) Private Team Award
     A. Trophies will be presented; encouragement awards will be presented to team members.
     B. The Ministry of Finance may notify relevant agencies of the list of award winners and publish it on the PPP Information Website to recognize their outstanding achievements.
     C. The authority-in-charge may include the award records of members of private teams in the evaluation criteria or sub-criteria in the review of private participation in infrastructure projects, and allocate appropriate points or weightings, or offer appropriate reductions in application deposits.
     D. Private institutions may negotiate with the authority-in-charge to reduce the royalties for the award-winning projects, with a maximum of five percent.
     E. The incentive period for the preceding two items begins on January 1st of the year following the publication of the list of award winners on the PPP Information Website. The incentive period is three years for the High Distinction Award, two years for the Excellence Award, and one year for the Honorable Mention Award.
 (3) Innovation Award
     A. Trophies will be presented.
     B. The Ministry of Finance may publish the list of award winners on the PPP Information Website to recognize their outstanding achievements.
 (4) Public Welfare Award
     A. Trophies will be presented.
     B. The Ministry of Finance may publish the list of award winners on the PPP Information Website to recognize their outstanding achievements.
 (5) Bilingual Benchmark Award
     A. Trophies will be presented.
     B. The Ministry of Finance may publish the list of award winners on the PPP Information Website to recognize their outstanding achievements.

4. Application Requirements and Qualifications 
 (1) The application project must meet one of the following conditions:
     A. The basic information is registered in accordance with the Operation Directions for Information Collection and Incentive Bonus Issuance for Private Participation in Infrastructure Projects by Authorities.
     B. For projects not handled in accordance with the Act for Promotion of Private Participation in Infrastructure Projects (hereinafter referred to as the Act), the type of infrastructure projects and the method of private participation comply with the provisions of the subparagraphs of Paragraph 1 of Article 3 and Subparagraphs 1 to 6 of Paragraph 1 of Article 8 of the Act.
 (2) Qualifications for Application
     A. The applicant (including cases with priority to enter into contract) has been in operation (excluding trial operation) for more than one year, and has not submitted an application in the previous year, and meets the following conditions:
      (A) Government Team Award
          The applicant has not received this award category and has demonstrated the following achievements:
        a. Innovative project content that helps to improve government finances, enhance public service quality, and increase economic efficiency.
        b. Efficient team performance and on-time project implementation.
        c. Active coordination and removal of project obstacles.
        d. Successful investment solicitation or negotiation strategies.
        e. The performance management plan is concrete and feasible, with well-executed management tasks.
        f. The investment contract content may serve as a reference for future projects.
        g. Achieved specific results through cross-agency or inter-unit coordination.
        h. Other significant contributions as self-assessed by the team of the authority-in-charge.
      (B) Private Team Award
          The applicant has not received this award category in the past five years (counting back from the previous year) and has demonstrated the following achievements:
        a. Excellent quality of public services.
        b. Improvement of economic efficiency.
        c. Fulfillment of social responsibility.
        d. Innovative management philosophy.
        e. Specific and outstanding achievements in promoting national bilingual policies.
        f. Other significant contributions as self-assessed by the private team itself.
     B. Projects handled in accordance with Subparagraph 6 of Paragraph 1 of Article 8 of the Act shall be submitted by both the government team and private team in the same year, or by the private team itself.

5. Application Method
 (1) Government Team Award
     A. The application shall be based on individual infrastructure projects, with a limit of eight government team members per project.
     B. The authority-in-charge or its authorized (or commissioned) agency of the individual project shall prepare the relevant documents and submit a written application within the application period stipulated by the Ministry of Finance.
 (2) Private Team Award
     A. The application shall be based on individual infrastructure projects, with a limit of eight private team members per project.
     B. The private institution shall prepare the recommendation forms from the authority-in-charge and relevant documents and submit a written application within the application period stipulated by the Ministry of Finance.

6. Evaluation Organization
 (1) Establishment and Dissolution of Evaluation Committee
     A. An Evaluation Committee is established to evaluate the applications for this award.
     B. The Evaluation Committee shall be established before the application period begins and shall be dissolved after the evaluation process is completed and there are no outstanding matters.
 (2) Duties of the Evaluation Committee
     A. To set or approve the evaluation items, criteria, and evaluation methods for the application projects.
     B. To conduct preliminary evaluation and re-evaluation of the application projects.
     C. To assist in explaining matters related to the evaluation process and results.
 (3) Evaluation Committee Members
     A. The Evaluation Committee shall consist of seven to seventeen members, selected by the Ministry of Finance from among individuals with relevant expertise or experience from industry, government, and academia. As a general principle, no fewer than one-third of the members shall be of the same gender.
     B. A convener shall be appointed by the Minister of Finance for each of preliminary and re-evaluation meetings, and shall be responsible for presiding over such meetings.
 (4) Working Group
     A. A working group of at least three members shall be established simultaneously upon the establishment of the Evaluation Committee to assist the Committee in handling matters related to the evaluation. The members shall be appointed by the Minister of Finance or his/her authorized personnel from among the Ministry of Finance staff or professionals.
     B. At least one member of the working group shall attend the Evaluation Committee meetings for the full duration.
 (5) Recusal Circumstances for Evaluation Committee and Working Group Members 
     A. Where the application involves the interests of the members, their spouse, relatives within the second degree of kinship, or family members living together with the member.
     B. Where the members or their spouse have an existing employment, mandate or agency relationship or had one within the past three years with the applicant or its responsible person.
     C. Where there is concrete evidence to suggest a risk that the members are incapable of performing their duties impartially.
     D. Other circumstances deemed by the member himself or the Ministry of Finance that the member may be incapable of performing his duties impartially.

7. Evaluation Procedure
 (1) Evaluation Meeting
     A. Evaluation Committee members shall conduct the evaluation impartially and shall not be represented by proxies at the meetings.
     B. More than half of the total number of members of the Evaluation Committee shall be present at the evaluation meeting, and its resolution shall be passed with the consent of more than two-thirds of the attending members.
 (2) Evaluation Criteria
     The evaluation items, criteria, and methods shall be established or approved by the Evaluation Committee after its establishment and made public; the same shall apply to any amendments thereof.
 (3) Evaluation Process
     A. Preliminary Evaluation
        After the working group reviews the completeness of the written documents for each application, it shall submit them to the Evaluation Committee, which will hold a preliminary evaluation meeting to determine the selected projects.
     B. Re-evaluation
        After on-site verification of the selected cases from the preliminary evaluation, a re-evaluation meeting shall be held to select the award winners of the High Distinction, Excellence, and Honorable Mention Awards for Government Team and Private Team, as well as the Innovation, Public Welfare, and Bilingual Benchmark Awards. Awards may be left vacant.
     C. Approval of the Re-evaluation Results
        The re-evaluation results shall be submitted to the Minister of Finance for approval.

8. Revocation of Award Qualification
For Private Team Award winners, if false information is provided during application or any of the following circumstances occur within five years after the winner list is published on the PPP Information Website, the authority-in-charge shall notify the Ministry of Finance, which may revoke the award qualification and publish the revocation on the PPP Information Website, and the incentive provisions of these Directions shall no longer apply:
 (1) The awarded project owes unpaid taxes and fails to rectify.
 (2) The awarded project has a fatal occupational disaster or a single incident resulting in three or more hospitalized casualties.
 (3) The awarded project, in violation of the Occupational Safety and Health Act or the Labor Inspection Act, has been imposed a cumulative administrative fine of NT$750,000 or more by labor inspection agencies, with the ratio of cases of penalties to the number of inspections reaching 20% or more.
 (4) The awarded project, in violation of environmental protection regulations, has been fined more than ten times by the competent authority.
 (5) Other major controversies that have damaged the image or the purpose of the award.

9. Awarded agencies (institutions) may be invited to participate in relevant observation sessions organized by the Ministry of Finance to discuss their experiences in promoting and engaging in private participation in infrastructure projects for reference and learning by relevant sectors.

10. The expenses required for handling this award shall be budgeted and supported by the Ministry of Finance.
For each award category, a maximum of two High Distinction Awards may be granted, and, in principle, the total number of awarded projects shall not exceed one-third of total applications received for the year. However, the number of Additional Award recipients is not subject to the aforementioned ratio restriction.
In principle, one-fifth of the total awarded projects referred to in the preceding paragraph shall be cases handled pursuant to Subparagraphs 4 and 5 of Paragraph 1 of Article 8 of the Act.
