Article 1

These Regulations are enacted pursuant to Article 16 of the National Property Act.

Article 2

The National Property Administration, Ministry of Finance (hereinafter referred to as “the NPA”) shall establish the Assessment Committee of National Property (hereinafter referred to as “the Committee”), consisting of 15 to 21 members, with no less than one-third of either gender. The Director-General of the NPA and one Deputy Director-General shall serve as ex-officio members, with the Director-General concurrently serving as the Chairperson. The remaining members shall be appointed by the NPA from the following:

  1. Two representatives from relevant departments of the Executive Yuan.

  2. One representative each from the Ministry of the Interior, the Ministry of National Defense, and the National Treasury Administration, Ministry of Finance, responsible for assessment or property management.

  3. Two to six representatives from municipal governments, responsible for assessment or land administration.

  4. Six to eight specialists, experts, or scholars in real estate assessment, property management, architecture, land administration, or urban planning.

Members specified in Subparagraph 4 of the preceding paragraph shall serve a two-year term and may be reappointed upon expiration of the term.

Article 3

The Committee’s scope of deliberation includes:

  1. Matters related to the evaluation methods of national property.

  2. Review of value and rent disputes concerning national property.

  3. Review of resolutions made by assessment subcommittees of each NPA branch.

  4. Other matters related to national property assessment.

Article 4

Committee meetings shall be presided over by the Chairperson. If the Chairperson is unable to attend, the attending members shall elect one among themselves to preside over the meeting.

Article 5

A quorum of more than half of all members is required to convene a meeting, and resolutions shall be adopted by a majority vote of the attending members.

Except for members appointed under Subparagraph 4 of Paragraph 1 of Article 2, who must attend in person, representatives from government agencies who are unable to attend may appoint a temporary substitute.

Substitutes appointed under the preceding paragraph shall be counted as attending members and shall have the right and responsibility to participate in meetings.

Article 6

The Committee shall, in principle, convene once a month, but the frequency may be adjusted as necessary.

Article 7

The Committee may invite representatives from relevant agencies to attend meetings and provide statements.

Non-Committee attendees shall not have voting rights.

Article 8

Committee members shall recuse themselves from meetings when deliberating cases in which they have a conflict of interest.

Article 9

Committee members shall serve without compensation but may receive allowances or review fees in accordance with regulations.

Article 10

The Committee shall have one Secretary and several Officers, appointed from NPA staff by the Director-General, to concurrently handle the Committee’s routine affairs under the Chairperson’s direction.

Article 11

Each NPA branch shall establish an assessment subcommittee, with its organization determined by the NPA.

Committee members shall not concurrently serve as members of an assessment subcommittee.

Article 12

These Regulations shall be enforced from the date of promulgation.

Amendments promulgated on December 16, 2011, shall be enforced from January 1, 2012.
Amendments promulgated on August 7, 2013, shall be enforced from January 1, 2013.
Amendments promulgated on March 28, 2017, shall be enforced from June 1, 2017.
