Article 1
To provide incentives for national non-public use land tender establishment superficiaries to build green buildings
and intelligent buildings, and to achieve the goal of promoting the development of the intelligent green building industry, these encouragement measures were established in accordance with the "Intelligent Green Building Promotion Program" approved by the
Executive Yuan.
Article 2
These encouragement measures are implemented by the branch offices of the National Property Administration,
Ministry of Finance.
Article 3
These encouragement measures are applicable to any superficiary who has signed a contract for the establishment
of superficies on national non-public use land through the tender process conducted by the implementation agency.
Article 4
During the continued existence period of the superficies rights, the superficiary may apply to the implementation
agency for concessionary land rent if the building on the ground has obtained a "Green Building Label" above, or, a silver level and the "Intelligent Building Label" or above, or, at the qualified level, is issued by the responsible authority, and has not
received any award related to the Green Building Label or Intelligent Building Label from the government authority during the same period of validity of these two labels.
If the aforementioned application is approved by the implementation agency, a concessionary land rent will be
granted from the month after the application month until the end of the month when both the "Green Building Label" and "Intelligent Building Label" are invalid. The concessionary land rent is limited to six years for the existence period of the same superficies
rights.
If the "Green Building Label" or " Intelligent Building Label" is cancelled, ceased to be used, or becomes invalid
after the superficiary has obtained the concessionary land rent in accordance with the preceding provisions, the concessionary land rent shall be cancelled, and the difference between the contractual and the concessionary rent from the date of cancellation,
cessation of use, or expiration of the label, shall be paid.
Article 5
The area of concessionary land rent shall be limited to the area of land corresponding to the buildings that
have obtained the "Green Building Label" and "Intelligent Building Label".
For staging partition of development, the entire region shall be reviewed together. The scope of the concessionary
land rent shall not be double-counted, and shall be in accordance with the preceding provisions.
Article 6
Land rent shall be collected on a preferential basis as follows:
1. Obtain a "Green Building Label" at the silver level, as well as the "Intelligent Building Label" at the qualified level, bronze level, silver level, gold level, or diamond
level, the land rent is calculated at 94%, 93%, 92%, 91%, or 90% of the contractual rent respectively.
2. Obtain a "Green Building Label" at the gold level, as well as the "Intelligent Building Label" at the qualified level, bronze level, silver level, gold level, or diamond
level, the land rent is calculated at 92%, 91%, 90%, 89% and 88% of the contractual rent respectively.
3. Obtain a "Green Building Label" at the diamond level, as well as the "Intelligent Building Label" at the qualified level, bronze level, silver level, gold level, or diamond
level, the land rent is calculated at 90%, 89%, 88%, 87%, or 86% of the contractual rent respectively. |
